The President of Turkey received the authority to independently declare mobilization.

The amended Regulations on Mobilization and the State of War gave the Turkish President the authority to independently declare general or partial mobilization in the republic in the event of relevant threats. This is stated in the new legislation.

The power to declare mobilization was transferred to the president from the government. The head of state will be able, by decree, to introduce a regime of partial or general mobilization in the event of “an uprising, a serious threat to the national security of the republic, its territorial integrity, or war.” We are talking about both internal and external threats. The corresponding document will be immediately published in the government gazette and will come into force.

Although formally, after publication, this decision will have to be immediately approved by parliament.

The updated law, which repealed several provisions passed since 1980, also stipulates that in the event of a decision to mobilize, all previously discharged military personnel from the armed forces, gendarmerie and coast guard will be considered in the reserves and may be called up.

As some Turkish media note, thus, those military personnel who were dismissed from the army during the period of emergency regimes, including on suspicion of participation in conspiracies or anti-government activities, are eligible for subscription. This also applies to those military personnel who were expelled from service after the coup attempt in 2016.

Conscription regulations for citizens abroad are also being introduced. Diplomatic missions will publish lists of reservists who need to return to their homeland. This will be considered an official subpoena.

The President will be able to put the “secret” stamp on decisions and circulars related to mobilization procedures. These concerns the principles, conditions, and procedures associated with this. The decision on confidentiality is made at the discretion of the head of state.
